1. Overview and Acceptance

This website is operated by Durazza. Throughout these Terms of Service (the "Terms"), "Durazza," "we," "us," and "our" refer to Durazza. These Terms govern your access to and use of durazza.com, including purchases made through the website, customer accounts, reviews, rewards features, and other services we make available (collectively, the "Service").

By accessing the Service or placing an order, you agree to these Terms and to the policies incorporated by reference, including our Privacy Policy, Refund Policy, and Shipping Policy. If you do not agree, do not use the Service.

Our online store is hosted by Shopify Inc., which provides the ecommerce platform that allows us to offer products and services to you.

2. Eligibility and Accounts

You must be at least the age of majority in your state, province, or territory of residence to make a purchase, or you must use the Service with the involvement and permission of a parent or legal guardian.

If you create an account, you are responsible for providing accurate information, maintaining the confidentiality of your login credentials, and promptly notifying us of suspected unauthorized use. You are responsible for activity performed through your account to the extent permitted by law.

3. Products and Product Information

Durazza offers a combination of original artwork and patterns designed by Durazza, collaborative designs, and complementary products curated by Durazza. The applicable product listing identifies the product, available options, materials, dimensions, care information, and design or curation attribution where relevant.

Some products are made to order, while others are held in inventory or supplied as curated products. Processing times vary by product and are described in the applicable listing or our Shipping Policy.

We make reasonable efforts to present product descriptions, photographs, dimensions, colors, materials, and prices accurately. Colors and appearance may vary because of screen settings, lighting, styled lifestyle imagery, material characteristics, and normal manufacturing or printing variation. Pattern placement may vary slightly between individually produced items. The selected size, material, format, scent, or other variant shown in the cart and order confirmation controls your purchase.

If we discover a material error affecting an order, we may contact you to confirm a correction, offer an appropriate alternative, or cancel and refund the affected item.

4. Availability and Purchase Limits

Products may be limited in quantity, discontinued, or available only through the website. Adding an item to a cart does not reserve it. We may limit quantities or decline orders when reasonably necessary to address inventory errors, suspected fraud, unauthorized resale, shipping restrictions, pricing errors, or misuse of the Service.

An automated order confirmation acknowledges that we received your order; it does not guarantee acceptance or fulfillment. If we cancel an order after payment has been collected, we will refund the canceled amount to the original payment method.

5. Prices, Payment, Taxes, and Import Charges

Prices are shown in the currency indicated on the website or at checkout and may change before an order is placed. A price change does not affect an order already accepted, except when we contact you about an obvious pricing or listing error and provide the option to cancel.

You agree to provide current, complete, and accurate billing, shipping, payment, and contact information. Payments are processed by Shopify and other payment providers made available at checkout, subject to their applicable terms.

Applicable sales taxes are calculated as required. Canadian orders may be subject to duties, taxes, brokerage charges, or import fees collected at checkout or upon delivery, depending on the shipment and carrier.

6. Shipping, Processing, and Delivery

Processing estimates, shipping rates, free-shipping eligibility, split shipments, tracking, address responsibilities, carrier delays, and delivery procedures are described in our Shipping Policy.

Any delivery date is an estimate unless we expressly confirm a guaranteed service in writing. If we cannot ship within the promised timeframe, we will provide an updated estimate and the options required by applicable law, which may include cancellation and a prompt refund for unshipped merchandise.

7. Cancellations, Returns, Exchanges, and Refunds

Cancellation deadlines, return windows, product-condition requirements, final-sale restrictions, bundle returns, restocking fees, return-shipping responsibilities, and refund timing are governed by our Refund Policy.

Nothing in these Terms limits rights or remedies that cannot legally be waived, including rights relating to damaged, defective, unsafe, misdescribed, or incorrectly supplied products.

8. Promotions, Discounts, and Rewards

Promotions, discount codes, gifts, rewards, and loyalty benefits may be subject to additional eligibility requirements, expiration dates, exclusions, redemption rules, and program terms displayed with the applicable offer. Unless expressly stated otherwise, promotions cannot be combined, applied retroactively, redeemed for cash, or used after expiration.

If specific published promotion or rewards-program terms conflict with this general section, the specific terms control for that offer or program. We may correct rewards or discounts issued because of fraud, abuse, duplication, or a technical error, subject to applicable law.

9. Intellectual Property

The Service and its contents, including the Durazza name and logo, product artwork and patterns, photographs, graphics, text, page designs, videos, downloads, and other materials, are owned by or licensed to Durazza and are protected by applicable intellectual-property laws.

You may use the Service for personal, noncommercial shopping and informational purposes. You may not reproduce, distribute, modify, publish, sell, license, scrape, exploit, or create derivative works from protected content without prior written permission from Durazza or the applicable rights holder.

If you believe content on the Service infringes your rights, contact hello@durazza.com with enough information for us to review the concern.

10. Reviews, Comments, Photos, and Other Submissions

If you submit a review, comment, photograph, video, testimonial, suggestion, or other content ("User Content"), you retain any ownership rights you have. You grant Durazza a nonexclusive, worldwide, royalty-free license to host, reproduce, format, display, and share that User Content for operating, improving, and promoting Durazza and the Service, subject to our Privacy Policy and applicable law.

You represent that you have the right to submit the User Content and that it is truthful, lawful, and does not violate another person's intellectual-property, privacy, publicity, or other rights. Do not submit confidential information, malicious code, unlawful material, impersonations, or paid endorsements that are not properly disclosed.

We may moderate or remove User Content that violates these Terms, applicable law, or our review standards. This section does not replace or modify any separate written agreement governing a design collaboration, commissioned work, or other creative project.

11. Acceptable Use

You may not use the Service to:

• violate any applicable law or another person's rights;
• commit fraud, submit false information, or place unauthorized transactions;
• upload malware or interfere with the security, availability, or operation of the Service;
• collect personal information about others without authorization;
• spam, phish, impersonate, harass, threaten, or discriminate against others;
• scrape, crawl, copy, or commercially exploit the Service except as permitted by law or authorized in writing; or
• circumvent purchasing limits, access controls, or security measures.

12. Product Use, Care, and Safety

Follow all product-specific warnings, care instructions, age recommendations, assembly directions, and safe-use information supplied on the listing, packaging, label, or accompanying materials. Stop using a product and contact us if you reasonably believe it presents a safety issue.

We may contact customers regarding updated safety information, corrective action, or a product recall. You agree to provide accurate contact information with your order so that we can communicate when necessary.

13. Third-Party Services and Links

The Service may contain links to third-party websites or features provided by payment, review, rewards, social-media, shipping, or other service providers. Those providers may have separate terms and privacy practices. Durazza does not control unrelated third-party websites and is not responsible for their independent content or practices.

This section does not remove Durazza's responsibilities as the seller of products purchased directly from durazza.com, including curated products fulfilled or produced with the assistance of third parties.

14. Privacy

Our collection, use, disclosure, and protection of personal information are described in our Privacy Policy. Additional privacy choices may be available through our cookie banner or data-sharing opt-out page.

15. Website Availability and Disclaimers

We work to keep the Service accurate, secure, and available, but we do not guarantee that the website will always be uninterrupted or free from technical errors. We may maintain, modify, suspend, or discontinue website features when reasonably necessary.

To the fullest extent permitted by law, the Service is provided on an "as available" basis. These website-related disclaimers do not override an express written product promise or any warranty, consumer protection, product-liability rule, or other right that cannot legally be excluded.

16. Limitation of Liability

To the fullest extent permitted by law, Durazza will not be liable for indirect, incidental, special, punitive, or consequential losses arising solely from use of or inability to use the website, including lost profits or lost data that were not a reasonably foreseeable result of our breach.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, a defective product where liability cannot be excluded, or any other liability or consumer remedy that applicable law does not allow us to exclude or limit.

17. Responsibility for Misuse

To the extent permitted by law, you are responsible for reasonably foreseeable losses and third-party claims resulting from your unlawful misuse of the Service, your infringement of another person's rights, or User Content you submitted in violation of these Terms. This section does not require a consumer to reimburse Durazza for losses caused by Durazza or for matters for which liability cannot lawfully be shifted.

18. Suspension and Termination

We may restrict or terminate access to the Service when we reasonably believe a user has violated these Terms, threatened the Service or another person, engaged in fraud, or created legal or security risk. Provisions that by their nature should survive termination, including payment obligations, intellectual-property protections, liability provisions, and dispute terms, will remain effective.

19. Governing Law and Consumer Rights

These Terms are governed by the laws of the State of Florida and applicable United States federal law, without regard to conflict-of-law principles. Subject to any mandatory law that provides otherwise, disputes relating to these Terms or the Service may be brought in the state or federal courts serving Lee County, Florida.

If you are a consumer outside Florida, including in Canada, you also retain any mandatory rights and protections provided by the laws of your state, province, territory, or country that cannot be waived by contract. Nothing in this section deprives you of those rights.

20. Changes to These Terms

We may update these Terms to reflect changes in the Service, our business practices, or legal requirements. The revised Terms will be posted with a new "Last updated" date. Changes apply prospectively when posted unless applicable law requires additional notice or consent.

21. Miscellaneous

If a provision of these Terms is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver of that provision. These Terms and the policies incorporated by reference constitute the agreement between you and Durazza regarding the Service, except for any separate written agreement that expressly applies.
